IT IS ESSENTIAL THAT YOU REVIEW AND UNDERSTAND THESE RULES PRIOR TO APPLYING TO PARTICIPATE IN THE PROGRAM. THERE IS NO PURCHASE NECESSARY TO PARTICIPATE.
BY APPLYING TO PARTICIPATE IN THE PROGRAM, AND IN CONSIDERATION OF BEING POTENTIALLY SELECTED TO PARTICPATE IN THE PROGRAM AS DESCRIBED HEREIN, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD AND AGREE TO THE TERMS AND CONDITIONS OF THESE OFFICIAL RULES (THE “RULES”).
1. Description
1.1 "THE PRICE IS RIGHT TONIGHT" (the “Program”) is a television series being produced by RSM PRICE PRODUCTIONS 1 INC. (“Producer”), a Canadian corporation with a registered office at 333 Bloor Street East, Toronto Ontario Canada M4W 1G9. It is produced for initial broadcast in Canada by Rogers Media Inc., which does business as Rogers Sports & Media (“Rogers”) and international distribution by FremantleMedia Limited (“Fremantle”). Fremantle owns the format rights in the Program.
1.2 The Program is a game show based on, but is not in all respects the same as, THE PRICE IS RIGHT® television series.
1.3 THESE RULES ARE THE OFFICIAL RULES THAT GOVERN APPLICATION AND PARTICIPATION IN THE PROGRAM AS AN AUDIENCE MEMBER (“PARTICIPANT”) AND/OR AS A PARTICIPANT SELECTED TO PLAY GAME(S) AND POTENTIALLY WIN PRIZE(S) (“CONTESTANT”).
2. Eligibility
2.1 In connection with submitting an application to be a potential Contestant and Participant in the Program, the applicant (“Applicant”) represents that they:
(a) are a legal resident of Canada and 19 years of age or older at the time of applying to be on the Program;
(b) have not been convicted of, and are not currently charged with or under indictment for, any criminal offense (excluding minor traffic violations) and there are no restraining orders against them; and
(c) have not been selected to appear as a contestant on a previous season of the Program or any “The Price is Right” program.
2.2 Applicants also represent that to the best of their knowledge, they are not (nor are any of their relatives) an employee or intern of any of the following:
(a) Producer, Rogers or their subsidiaries or affiliates;
(b) Fremantle or its subsidiaries or affiliates; or
(c) any person, manufacturer or other firm supplying prizes to the Program.
2.3 Applicants must disclose to Producer any changes impacting their eligibility after they apply, including after receiving an invite to be a Participant. Producer reserves the right in its sole discretion to disqualify any Applicant or Participant based on such disclosures or as otherwise outlined in these Rules.
3. Application
3.1 To apply for consideration as a Participant and potential Contestant on the Program, each Applicant must submit an online application at thepriceisrighttonight.ca
(the “Application Site”), during the specified casting period, for receipt by Producer, by accurately entering and submitting all information required on the online application form (including name, hometown, occupation, personal details/stories and optional application/videos (collectively, the “Submitted Content”)). Producer reserves the right to introduce other application methods in its sole discretion.3.2 Each Applicant represents and warrants that the Submitted Content:
(a) is true and accurate;
(b) contains information and images of only them, or if information and images of any third party is included in the Submitted Content, they have full permission from that third party to share the Submitted Content;
(c) does not contain any material, language or gesture that is defamatory, indecent, profane, obscene or violent;
(d) is original and that they own or control, to the full extent necessary for Producer to use the Submitted Content, all right, title, and interest (including copyright and all underlying rights therein) in the Submitted Content;
(e) does not infringe upon the intellectual property or other statutory or common law rights of any third party;
(f) does not contain any recognizable logos or any other copyrighted material;
(g) does not contain any mention, endorsement, or “plug” any commercial product, service, venture or thing; and
(h) has not been submitted in connection with any other production and/or promotional campaign.
3.3 Only eligible applications received by the deadline set out on the Application Site will be reviewed and considered by Producer. The deadline and details for applications may change at the sole discretion of the Producer and will be updated on the Application Site.
3.4 Applicants will be notified by phone or email if they are invited to be a Participant in the Program. Invitations to be a Participant are personal and non-transferable, and guests are not permitted except at the sole discretion of Producer. Due to the volume of Applicants, unsuccessful Applicants will not be contacted. Odds of being invited to be a Participant will depend on the number and quality of the applications.
3.5 Applicants may be required to undergo background checks, including without limitation, social media checks and criminal background checks. Producer reserves the right in its sole discretion to disqualify any Applicant, Participant or Contestant found to be in violation of these requirements or based on these background checks.
3.6 Applicants are subject to these Rules and any other terms at the Application Site. Applicants who are invited to be a Participant must read, agree to and sign the Participant Release Form (the “Release”) and other required documents prior to participating in the Program.
3.7 Applicants who are invited to be Participants in the audience for filming of the Program will be in an audience of a group of up to 200 people and may be chosen from the audience to compete in the Program as a Contestant, in the sole discretion of Producer. All travel and all time taken to participate in the Program will be at Participant’s sole risk and expense.
3.8 Producer, Rogers and Fremantle and each of their affiliates, partners, licensors, dealers, representatives, suppliers and agents (and their respective employees, officers, directors, shareholders and representatives) (the “Released Parties”) do not accept any responsibility for any technical issues with the Application Site or any other application method, or an application not being received for any reason.
4. Program & Games Processes
4.1 The Program and individual Program games will proceed approximately as described in this section, and Contestants will be briefed on more detailed game processes and rules prior to or during the Program. Without liability and in its sole discretion, Producer reserves the right to make determinations about and change the order of the Program, number of games and Contestants, individual games, game processes and/or game rules at any time, and shall have final say on the outcomes of all games. All such determinations, changes and outcomes shall be final and are not subject to appeal.
4.2 Contestants acknowledge and agree that any advice and instruction given by the Program host is intended to be for entertainment only. Should a Contestant decide to follow all or any such advice, this decision shall be entirely at their own risk.
4.3 The Program will take place in the following approximate order with the following approximate number of contestants (subject to change at any time for any episode of the Program at the sole discretion of Producer):
(a) 1st One Bid Game – 4 Contestants (Participants from the audience);
(b) 1st Pricing Game – 1 Contestant (winner of the 1st One Bid Game);
(c) 2nd One Bid Game – 4 Contestants (3 remaining from 1st One Bid Game, plus 1 from the audience;
(d) 2nd Pricing Game – 1 Contestant (winner of 2nd One Bid Game);
(e) 3rd One Bid Game – 4 Contestants (3 remaining from 2nd One Bid Game, plus 1 from the audience;
(f) 3rd Pricing Game – 1 Contestant (winner of 3rd One Bid Game);
(g) 4th One Bid Game – 4 Contestants (3 remaining from 3rd One Bid Game, plus 1 from the audience;
(h) 4th Pricing Game – 1 Contestant (winner of 4th One Bid Game);
(i) 5th One Bid Game – 4 Contestants (3 remaining from 4th One Bid Game, plus 1 from the audience;
(j) 5th Pricing Game – 1 Contestant (winner of 5th One Bid Game);
(k) Big Wheel Showdown – 5 Contestants (contestants who played the 5 Pricing Games);
(l) 1st Grand Prize Showcase – 1 Contestant (1st place contestant in the Big Wheel Showdown);
(m) 2nd Grand Prize Showcase – 1 Contestant (2nd place contestant in the Big Wheel Showdown).
4.4 One Bid Games:
(a) Participants are selected from the audience to appear on stage as Contestants and stand at podiums in the order in which they were selected.
(b) The Contestants will be presented with an item and asked in sequence (order determined by Producer) to place a bet on the price of the item.
(c) No Contestant may bid the exact same price on the same item as another Contestant and the Contestant who bids closest to the retail price of the item without exceeding the retail price wins the game round.
(d) Winner of the game round will move on to play a Pricing Game and may be invited to participate in the Big Wheel Showdown.
4.5 Pricing Games may consist of any 5 of the following (or other games as determined by Producer in its sole discretion), and will be played based on game processes and rules set out prior to or during the Program:
(a) “Any Number Game”
(b) “Cliff Hangers Game”
(c) “Checkout Game”
(d) “Hole in One Game”
(e) “The Plinko® Game”
(f) “Let Em Roll Game”
(g) “Master Key Game”
(h) “Race Game”
(i) “Switcheroo Game”
(j) “Punch a Bunch Game”
(k) “Grocery Game”
(l) “One Away Game”
(m) “Half Off Game”
(n) “It’s In the Bag Game”
(o) “Clock Game”
(p) “Hi Lo Game”
(q) “3 Strikes Game”
(r) “Temptation Game”
(s) “Time Is Money Game”
(t) “Spelling Bee Game”
4.6 Big Wheel Showdown: Contestants who participated in the Pricing Games may be invited to participate in the Big Wheel Showdown to determine which Contestants will participate in the Grand Prize Showcase(s), based on game processes and rules set out prior to or during the Program.
4.7 Grand Prize Showcases: Contestants who came in 1st place and 2nd place in the Big Wheel Showdown will compete to win a Grand Prize Showcase. Only 1 Contestant will with their Grand Prize Showcase based on game processes and rules set out prior to or during the Program.
5. Prizes
5.1 Contestants will be required to sign and return to Producer a payment direction (for cash prizes) and other prize documents including a release on Producer’s standard form prior to receipt of any prize.
5.2 Prizes will be provided to the applicable winning Contestant(s) after production of the Program is completed. Contestants will be informed by Producer regarding their prize provision method and timing, which will be in Producer’s discretion depending on the prize and may occur up to 6 months from the date of initial broadcast of the Program.
5.3 Travel prizes must be booked within 30 days of being contacted by the prize provider’s prize coordinator and must be taken and completed within 1 year of the date of filming of the Program on which they were won. Any travel prizes not taken within the applicable time limitations will be forfeited as described in paragraph 5.7 below.
5.4 Contestants will bear all the costs and responsibility relating to delivery and use of their prizes, including without limitation, installation, operation and safekeeping. Any such costs (such as costs for delivery, extended warranties, insurance, license plates, fuel, electricity, contractors, etc.) will not be included in the prize, unless expressly noted. For additional clarity, for travel prizes, Contestants will be subject to terms, conditions and restrictions of the prize provider, and travel and hotel reservations will be subject to availability. Preferred travel dates will be honoured if available. Blackout dates, seasonal limitations, travel documentation requirements and other conditions are beyond the control of Producer.
5.5 Prizes may not be exactly as promoted or displayed in the Program. For example, car prizes may not be the exact make, model, colour or year as the one displayed in the Program. The prizes are provided “as is” without representation or warranty of any kind by the Producer, Rogers, Fremantle or prize providers, including without limitation, warranties as to the reliability, durability or suitability. Producer reserves the right to enhance, embellish and decorate the prizes for production purposes without it forming part of the prize. Producer reserves the right, in its sole discretion, to substitute a prize, in whole or in part, with a prize or prize component of equal or greater value if the prize or prize component cannot be awarded for any reason.
5.6 Prizes and prize components cannot be assigned, transferred, exchanged for another item, cash or credit, or sold.
5.7 Prizes must be accepted as awarded. Contestant’s:
(a) receipt of a prize or prize component;
(b) failure to accept or use a prize or prize component (which will constitute a forfeiture of such prize/component); or
(c) failure to advise Producer, within 1 year of the date of initial broadcast or within 6 months of the 1 year anniversary of filming of the Program on which they participated, that they did not receive a (non-travel) prize or prize component (which will constitute a forfeiture of such prize/component), will automatically release Producer, Rogers, Fremantle and the prize provider from all obligations relating to that prize or prize component, as applicable. Prizes will not be replaced if not used, lost, destroyed, damaged or stolen, and in the case of a travel prize, will not be replaced if not taken for any reason.
6. Prize Values and Retail Prices
6.1 All prize values or retail prices mentioned in the Program, including in any games, are in Canadian dollars, and are based on regular retail prices or prices suggested by various manufacturers and/or suppliers, not considering variations resulting from commercial campaigns of any distributors in different parts of the country. Contestants will not be compensated if the actual prize value or retail price differs from the value or retail price stated on the Program.
7. Release and Use of Likeness
7.1 By applying for and/or participating in the Program, all Applicants, Participants and Contestants agree to the filming, recording and otherwise capturing or documenting of their likeness, voice, appearance and activity (the “Captured Content”), and agree that the Captured Content, along with the Submitted Content (collectively, the “Content”), may be incorporated in the Program and/or in any publicity material for the Program, in whole or in part at Producer’s discretion. Producer is under no obligation to use the Content.
7.2 For clarity, Applicants, Participants and Contestants acknowledge and agree that in the Content and the Program, they may reveal, and/or other parties may reveal about them, information of a personal, private or surprising nature that may or may not be fully factual. They also acknowledge and agree that their portrayal in the Content may be seen as disparaging, embarrassing or otherwise unfavourable, and that such Content may be incorporated in the Program and/or in any publicity material for the Program, in whole or in part at Producer’s discretion.
7.3 Applicants, Participants and Contestants waive all “moral rights” and assign to Producer, all rights, including without limitation, copyright and neighbouring rights (if any) with respect to their contribution to the Program and in the Content. Applicants, Participants and Contestants consent to the exploitation of the Content, the Program or any part(s) of the Program by all means and in all media and formats whether now known or hereafter invented throughout the world in perpetuity, without compensation to Applicants, Participants or Contestants.
7.4 Participants’ and Contestants’ appearance or activity on the Program is not a performance and they are not entitled to wages, salary or other compensation.
7.5 There is no obligation on the part of Producer, Rogers or Fremantle to record, broadcast or promote the Program or any part thereof.
8. Confidentiality
8.1 Applicants, Participants and Contestants must keep all non-public information about the Program confidential at all times. For clarity, any information relating to their participation in the Program, including without limitation, games played, winners and prizes, must be kept confidential until the broadcast of the Program episode in which they participate. Furthermore, Applicants, Participants and Contestants must not make disparaging remarks about the Program or any elements thereof at any time. Media inquiries must be directed to contacts provided by Producer. Disclosure of non-public information and disparaging remarks will constitute a material breach of these Rules and the Release and will cause Producer substantial and irreparable injury and will cause substantial damages.
9. Privacy
9.1 Personal information collected during the application and selection process, and during production of the Program will be collected, used and disclosed for the purposes of selecting Participants and Contestants, producing or administering the Program, and/or as otherwise disclosed in the Application, these Rules, and the Releases. Producer will not transfer your personal data to third parties, except in cases where it is necessary for the purposes noted above or to comply with legal obligations to which Producer is subject. 10. General Rules
10.1 These Rules are in addition to, and do not supersede, the Release or other Program or prize documents signed by me (“Releases”). In the event of any conflict between any Release and these Rules, the Release will prevail. The rights granted in a Release are non-revocable. The Releases and Rules shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. The parties submit to the exclusive jurisdiction of the courts of Ontario.
10.2 It is a condition of participation in the Program that Applicants, Participants and Contestants agree to and fully comply with these Rules, the Releases, and any other processes, instructions and rules regarding the Program and individual Program games and prizes devised from time to time by Producer, as applicable. All Applicants, Participants and Contestants acknowledge that the Program will be conducted in English.
10.3 It is also a condition of participation in the Program that Applicants, Participants and Contestants at all times behave appropriately and in accordance with all local, provincial, territorial and federal laws and regulations, and accept full responsibility for their behaviour, and acknowledge that they will not be protected by Producer from any violation of law.
10.4 Producer reserves the right, in its sole discretion, to disqualify and/or replace any Participant or Contestant from the Program at any time and/or require the return of any prize, including without limitation, for non-compliance with paragraphs 10.2 and 10.3 or for reasons such as:
(a) a Participant or Contestant attempting to cheat, rig or otherwise falsely, unfairly or illegally influence or alter the outcome of any portion of the Program, including without limitation, tampering or attempting to tamper with the application process, the operation of the Program games or prizes;
(b) a Participant or Contestant withholding any information from, or providing any false or misleading information to, Producer and/or any of its designees;
(c) unlawful or inappropriate conduct (as determined by Producer in its sole discretion) by a Participant or Contestant, including without limitation, stealing or misappropriating property, harming any person, damaging a location or property, harassment, acts of violence or anything that might affect the safety or performance of another person or the Program;
(d) any conduct by a Participant or Contestant that would be reasonably likely to reflect unfavourably upon or bring the Program, Producer, Rogers, Fremantle or any sponsor of the Program into disrepute, scandal, contempt or ridicule; or
(e) in the case of ill health or other health-related matters of any Participant or Contestant.
10.5 Without liability and in its sole discretion, Producer reserves the right to:
(a) change these Rules, and the individual Program games and their rules, without prior notice;
(b) change the structure, process, timing, duration or any other aspect of the Program, whether due to technical difficulties or otherwise; and
(c) suspend or cancel the Program in whole or in part.
10.6 All decisions regarding the Program will be made exclusively by Producer and/or Fremantle (as applicable), including without limitation, Participant or Contestant selection, game play and the award, or not, of any prizes. All decisions shall be final and are not subject to appeal. Producer’s failure to enforce these Rules or individual game rules on one occasion or in connection with a particular Participant or Contestant will not preclude Producer from enforcing such rules on another occasion or with respect to a different Participant or Contestant. In the event of a situation not provided for in these Rules, all decisions of the Producer and/or Fremantle (as applicable) are final.
10.7 Applicants, Participants and Contestants waive and release the Released Parties defined above from any and all claims, actions or demands arising out of or in any way resulting from the application and selection process for the Program, the Content or their participation in the Program (including without limitation, their portrayal, disputes about and outcomes of game play, reliance on Program host advice, and issues relating to the delivery, quality, possession or use of any prize), unless caused solely and directly as a result of the applicable Released Party’s negligence and only following the judgement of a court of final judgement.
